Gaddy v COP Status Report

We hope this message finds you safe and well in these very difficult times.

We recently filed our Motion for Leave to file an Amended Complaint, along with a Copy of the proposed Amended Complaint ("AC"). The Church will oppose the Motion, we will reply and then the Court will rule. If the Court grants our Motion, the Church will no doubt move to dismiss again and another round of briefing will ensue. If the Court denies our Motion, we will appeal to the 10th Circuit Court of Appeals. This process is typical of civil litigation. To view the Motion and the AC, please click links below.

Gaddy v COP Status Report

COP (Corporation of the President of the Church of Jesus Christ of Latter-day Saints) filed a motion to dismiss the Amended Complaint. See here: Gaddy Motion to Dismiss Amended Complaint We made a motion to allow an opposition brief of 9,000 words (the limit is ordinarily 6,500). As of the July 14, the filing deadline, we had not received a ruling from the Court and so filed a version that was approximately 6,500 words. See here: Gaddy Opposition to Motion to Dismiss Amended Complaint. Within about an hour, Judge Shelby granted our request for 9,000 words and since it was after we had already filed a short version, gave us another week to file the longer version. See Order here. Gaddy Order Granting Overlength Response. We will send you a link to the Amended Opposition (longer version) once it is filed and continue to keep you updated.

We fully anticipate that the case will be appealed to the 10th Circuit Court of Appeals. At almost a year to date after filing, the case is very much alive and we are confident in our position.
