RFM Wins on Appeal Before Utah Records Committee!

Just had the hearing.

We won!

The Utah Records Committee just voted unanimously that the BYUPD improperly classified the police reports AND the audio tapes of the interviews as not subject to GRAMA.

Judge Laura Scott has still not issued her ruling in the other case on appeal before her, and this decision by the Records Committee is subject to her ruling that BYUPD is a governmental agency and is therefore subject to GRAMA.

Which is what everybody, including the five-member State Records Committee, understands she is going to do.

How is the ruling that the tapes are not subject to GRAMA a win?
Good faith does not require evidence, but it also does not turn a blind eye to that evidence. Otherwise, it becomes misplaced faith.

Consiglieri and any other interested party should be able to acquire full, unredacted versions of the interviews. We do not know what we will find out.

One question here.

Other than being required to release properly redacted copies of the materiel in question, will there be any other repercussions for the BYUPD for not following state law?

Not if they promptly release the records ordered by the Committee.

In some states, governmental agencies can get fined a penalty per day for not releasing records prior to appellate review, but I don't see that in the GRAMA statute.

If they continue to refuse without appealing, however, there could be monetary ramifications.

This is good. The Church would like to turn Utah, but especially B.Y.U. into it own little country, just like Joseph Smith wanted to do with Nauvoo. I'm glad to see that not everybody goes along with that.

Would the Church's next level of appeal be to the Utah State Supreme Court?

This is great - you'd think the one true church would be happy with transparency, but glad we'll get a little bit of it one way or another.

I am seeing that Judge Scott released her detailed ruling yesterday, according to the SLT. Anyone have a link? I can't find the actual text of it.
